§ 1. Definitions

1. The terms written in capital letters shall have the meanings defined below:

a) Car Park Pass – a document confirming the right to use the Car Park Services, 

b) Consumer – a natural person entering into a legal transaction with TOBILET.PL that is not directly related to their business or professional activity,

c) Airport – Poznań-Ławica Henryk Wieniawski Airport, 

d) Airport Operator – PORT LOTNICZY POZNAŃ-ŁAWICA sp. z o.o., with its registered office in Poznań, at 285 Bukowska Street, 60-189 Poznań, entered into the Register of Entrepreneurs of the National Court Register, registration files kept by the District Court of Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number: 0000003431, NIP: 7811533610, with share capital of PLN 337,385,000.00,

e) Car Park Operator – APCOA Polska sp. z o.o., with its registered office in Warsaw, at Rondo ONZ 1, 00-124 Warsaw, entered into the Register of Entrepreneurs of the National Court Register, registration files kept by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number: 0000129400, NIP: 5260307689, with share capital of PLN 3,000,000.00, 

f) Car Parks – car parks located within the Airport premises, operated by the Car Park Operator,

g) TOBILET.PL Sales Platform – a ticket sales platform for various cultural, sports, trade fair, and concert events, as well as a platform enabling the purchase of Services, operated by TOBILET.PL, available within the scope covered by the Terms and Conditions via the Website,

h) Sole Trader – a natural person who enters with TOBILET.PL into an agreement directly related to the Sole Trader's business activity, where the content of the agreement indicates that it is not of a professional nature for this person, resulting in particular from the subject of the Sole Trader's business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity,

i) Privacy Policy – a document describing the rules for the processing of Users' personal data by TOBILET.PL in connection with the Services provided by TOBILET.PL. The Privacy Policy is available at the following internet address https://airportpoznan.pl/polityka-prywatnosci-airport.

j) Terms and Conditions – these Terms and Conditions of Website www.airportpoznan.pl,

k) GDPR – the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119 of 4 May 2016, page 1),

l) Website – a website operated at www.airportpoznan.pl by TOBILET.PL, integrated with the TOBILET.PL sales platform, enabling the purchase of Services,

m) TOBILET.PL – Międzynarodowe Targi Poznańskie sp. z o.o. (Poznań International Fair) with its registered office in Poznań, ul. Głogowska 14, 60-734 Poznań, entered into the Register of Entrepreneurs of the National Court Register, registration files kept by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000202703, and to the register of active VAT payers - NIP: 777-00-00-488, share capital of PLN 434,256,000.00, having the status of a large enterprise within the meaning of the Act on Counteracting Excessive Delays in Commercial Transactions (consolidated text Journal of Laws of 2023, item 1790, as amended),

n) Business Executive Lounge service – a service providing access to a designated lounge area during the waiting time for a flight departure, including catering options such as hot and cold beverages, sandwiches, sweet and savoury snacks, and a wide selection of alcoholic drinks, as well as access to daily newspapers, wireless Internet, and office equipment, provided by the Airport Operator,

o) Drive Me service – a private transport service from the terminal to the aircraft or from the aircraft to the arrivals hall, provided by the Airport Operator,

p) FAST TRACK service – a service providing access to a dedicated fast track at access control and security screening at the Airport, provided by the Airport Operator,

q) Meet&Assist service – a service including priority check-in and baggage drop-off, fast-track security screening, and waiting for the flight departure in a designated lounge area, with the assistance of an Airport Operator staff member, provided by the Airport Operator.,

r) VIP Check-In service – a service providing access to check-in facilities at the Airport, including:

  • coordination of ticketing and baggage check-in, passport control, customs clearance, and security screening,
  • expedited processing – 45 minutes before the flight departure,
  • transport between the VIP area located at the Airport and the aircraft,
  • the possibility of waiting for departure in the VIP Lounge located at the Airport,
  • assistance from staff trained in diplomatic protocol,
  • refreshments, including snacks,
  • wired Internet access and Wi-Fi,
  • hotel booking service and taxi ordering (upon the User's request) by Airport staff, 

provided by the Airport Operator,

s) Airport Operator Services – Car Park Service, FAST TRACK Service, Business Executive Lounge Service, Drive Me Service, Meet & Assist Service, VIP Check-in Service,

t) Car Park Service – the service of providing a parking space, carried out by the Airport Operator in cooperation with the Car Park Operator, 

u) Services – services provided by TOBILET.PL via the Website, as specified in § 2 sec. 4,

v) PCRA – the Polish Consumer Rights Act of 30 May 2014 (consolidated text Journal of Laws of 2024, item 1796), 

w) User – a user of the Website.

2. The above definitions, when used in the singular, shall apply accordingly to the plural, and when used in the plural, shall apply accordingly to the singular, unless explicitly stated otherwise in the Terms and Conditions. 

§ 2. General Provisions

1. The Terms and Conditions define the rules for using the Website, the type and scope of Services, the conditions for providing Services, the terms of concluding and terminating agreements for the provision of Services, and complaint procedures. 

2. The Terms and Conditions also constitute the regulations for the provision of electronic services, as referred to in Art. 8 of the Act of 18 July 2020 on the provision of electronic services (consolidated text Journal of Laws of 2024, item 1513, as amended). 

3. The owner and administrator of the Website is “TOBILET.PL”.

4. Through the Website, TOBILET.PL provides the following Services electronically: 

a) reservation of a Car Park Pass,

b) intermediation in the sale of the FAST TRACK Service, 

c) intermediation in the sale of the VIP Check-in Service, 

d) intermediation in the sale of the Drive Me Service, 

e) intermediation in the sale of the Business Executive Lounge Service,

f) intermediation in the sale of the Meet & Assist Service, 

g) enabling browsing of content available on the Website,

h) chat.

5. For the avoidance of doubt, TOBILET.PL emphasises that the Terms and Conditions apply exclusively to the provision of Services (as part of the Website). In the case of the Car Park Pass booking Service, TOBILET.PL only books a Car Park Pass for the User, while the Car Park Service is provided by the Airport Operator in cooperation with the Car Park Operator, according to the regulations applied by the Airport Operator. In the case of intermediary Services for the sale of Airport Operator Services other than the Car Park Service, the Services are limited to the intermediation in the sale of a given Airport Operator Service, sold and provided by the Airport Operator, according to the regulations applied by the Airport Operator.  TOBILET.PL has no influence on the provision of services by the Airport Operator, the Car Park Operator, or the content of the regulations applied by the Airport Operator.

6. Users may be: (i) Consumers, (ii) Sole Traders, (iii) natural persons conducting business, gainful or professional activities other than Sole Traders, as well as (iv) persons representing or otherwise acting on behalf of legal persons or organisational units without legal personality.

7. In connection with the provision of the Services listed herein, Users can contact TOBILET.PL by phone: +48 61 250 92 55, email: info@tobilet.pl or by post: ul. Głogowska 14, 60-734 Poznań. The Customer Service Department is open on working days from Monday to Friday from 8:00 a.m. to 5:00 p.m.

8. For all matters related to the provision of Car Park Services, please contact the Car Park Operator by email: lawica@apcoa.pl, by phone: +48 696 041 162 or by post: APCOA Polska sp. z o.o. with its registered office in Warsaw, Rondo ONZ 1, 00-124 Warsaw.  For all matters related to the provision of other Airport Operator Services, please contact the Airport Operator by email: info@airport-poznan.com.pl, by phone: +48 61 849 22 99 or by post: PORT LOTNICZY POZNAŃ-ŁAWICA sp. z o.o. with its registered office in Poznań, ul. Bukowska 285, 60-189 Poznań.

9. The costs of using means of distance communication to use the Website, including the use of Services and the conclusion of agreements regarding Services, as well as to contact TOBILET.PL, the Car Park Operator and the Airport Operator, correspond to the rates of the User's network operator.

10. TOBILET.PL holds exclusive rights to the Website.  Users are entitled to use the Website: (i) only to the extent necessary to use the Services, by displaying and browsing it on a computer or mobile device in accordance with the Terms and Conditions, or (ii) to the extent of permissible use permitted by law. 

11. TOBILET.PL holds exclusive rights to the text and graphic materials, including works within the meaning of the Act on Copyright and Related Rights, which are posted and distributed on the Website by TOBILET.PL.  Users are entitled to use the aforementioned materials only to the extent necessary to use the Services or within the scope of permissible use as defined by law.  The use of the aforementioned materials in a scope other than that specified in this Article is permitted only with the prior written consent of TOBILET.PL, otherwise being null and void. 

12. The use of services provided through the Website is free of charge, subject to the need to pay for the reservation of a Car Park Pass (and at the same time for the Car Park Service) and for the intermediation of TOBILET. PL in the sale of Airport Operator Services other than the Car Park Service (and at the same time for these Airport Operator Services), as well as paying a fee to an external payment operator cooperating with TOBILET.PL in the case of making payments specified herein.

13. The rights and obligations related to the Services may not be transferred to a third party. 

14. Banners and links to websites or online services may be published on the Website.  By using the banners and links referred to in the preceding sentence, the User is transferred to websites or services external to the Website.  The use of these websites or services, as well as the processing of the User's personal data in connection with their use, is not subject to the Terms and Conditions and the Privacy Policy.

15. The User is obliged to use the Website, including the Services, in accordance with the Terms and Conditions and in accordance with applicable law.

16. When using the Website, including the Services, it is prohibited to: 

a) provide any illegal content, 

b) provide any content that violates the provisions of generally applicable law or decency,

c) use the Website, as well as to use any data, information, materials, etc., posted on the Website, for commercial purposes,

d) copy, change, distribute, process, transfer, including selling, granting paid or unpaid use on any legal basis, the Website as a whole or any of its elements, excluding actions within the limits of generally applicable law,

e) separate and make any attempts to separate the source code of the Website, excluding actions within the limits of generally applicable law,

f) use bots or other automated tools enabling the performance of any actions on the Website without human intervention.

§ 3. Terms of Service, Including Technical Requirements for Using the Website

1. TOBILET.PL provides Services via the Website exclusively under the terms and conditions described herein.

2. Use of the Services via the Website requires acceptance of the Terms and Conditions and the Privacy Policy.

3. The User is responsible for starting and stopping the browsing of the content available on the Website.

4. Only a User with full legal capacity can purchase Services.

5. To use the Website, including the Services, it is necessary to use a device:

a) equipped with a minimum of 2 GB RAM (memory),

b) with a display resolution of not less than 750x1334 pixels (or 720x1280 for Android),

c) reproducing the image,

d) with Android OS (minimum 4 latest full versions, i.e. Android 11, Android 12, Android 13 or Android 14 or newer) or iOS (minimum 4 latest full versions, i.e. iOS 15, iOS 16, iOS 17, iOS 18 or newer), 

e) ensuring access to the public telecommunications network Internet with a connection speed of at least 3 Mbps using one of the following browsers in their current versions (not older than one year): Google Chrome 132+, Mozilla Firefox 136+, Safari 18+, Microsoft Edge 130+, and newer, 

f) providing an application for Javascript and Cookies and a programme for handling PDF files.

6. Any irregularities in the functioning of the Website shall be reported to TOBILET.PL (see § 2 sec. 7 hereof).

§ 4. Car Park Pass Booking Service

1. The agreement for the booking of a Car Park Pass is concluded when the User clicks on the “I order with obligation to pay” button, under the condition precedent that TOBILET.PL receives the payment made by the User, which shall be understood to mean crediting the bank account of TOBILET.PL with the full amount of the transaction, within 3 hours of the User clicking on the “I order with obligation to pay” button. 

2. In order to conclude a Car Park Pass booking agreement, it is necessary to:

1) provide data regarding the start and end date of using the Car Park and the vehicle registration number,

2) choose an available Car Park,

3) provide the User's data: e-mail address, first name, surname and telephone number,

4) choose a payment method from among those indicated in item 8) below,

5) read and accept the Terms and Conditions, Privacy Policy, regulations applied by the Airport Operator and regulations applied by the external payment operator cooperating with TOBILET.PL – Website www.payu.pl, 

6) submit a declaration that the User demands full performance of the Service within the time limit specified in the order, even if any part of the service is provided before the expiry of the time limit for withdrawal from the agreement (by the Consumer and the Sole Trader), as well as acknowledges that upon the provision of the service in the aforementioned part, they will lose the right to withdraw from the agreement in this part (if they are a Consumer or a Sole Trader),

7) make a payment via an external payment operator cooperating with TOBILET.PL - the Website www.payu.pl, using one of the following payment methods:

a) VISA Mobile,

b) VISA or Master Card,

c) Google Pay,

d) BLIK,

e) bank transfer,

in accordance with the terms and conditions applied by the website www.payu.pl.

3. When booking Car Park Passes and making the payment, the User shall exercise due diligence. Entering incorrect data may result in the refusal to post the payment and cancellation of the transaction.

4. By clicking the “Order with payment obligation” button, the User expresses their willingness to conclude a Car Park Pass booking agreement and at the same time secures for themselves – for the period indicated in this section – the possibility of concluding this agreement. After clicking the “Order with payment obligation” button, TOBILET.PL sends the User an order confirmation to the email address provided by the User, and the User is redirected to the website of an external electronic payment operator cooperating with TOBILET.PL. The User will lose the opportunity to conclude a Car Park Pass booking agreement, and the agreement in question will not be concluded if TOBILET.PL fails to receive payment made by the User - which should be understood as crediting the bank account of TOBILET.PL with the full amount of the transaction - within 3 hours of the User clicking on the “Order with payment obligation” button. The user should verify that the bank account of TOBILET.PL has been credited with the full amount of the transaction and, in case of any problems, contact the external electronic payment operator cooperating with TOBILET.PL.

5. Upon receipt of the payment made by the User, understood as crediting the bank account of TOBILET.PL with the full transaction amount, TOBILET.PL sends the User a purchase confirmation (as an email attachment) and a payment confirmation to the email address provided by the User. TOBILET.PL also sends an invoice to the e-mail address provided by the User in the form of an attachment, provided that the User has agreed to receive it before clicking the “Order with payment obligation” button and has provided the details of the entity to be indicated on the invoice. 

6. In order to receive the Car Park Pass in accordance with the booking, the User is obliged to scan the code on the booking confirmation received by e-mail in the device located on the parking post at the entrance to the relevant Car Park. In exchange for receiving a Car Park Pass in accordance with the booking, the User is not obliged to make any payments other than the payment made to conclude the Car Park Pass booking agreement.

7. In case of any doubts as to the correctness of the booking process of Car Park Passes, please contact the Customer Service Department.

8. The User is obliged to check that the data/information contained in the purchase confirmation corresponds to the order placed.

9. Until the date and time for which the Car Park Pass has been booked, the User has the option to change them. 

10. The Car Park Pass booking confirmation may not be altered or copied.

11. The prices of the Car Park Passes, and therefore also their reservation in accordance with the Terms and Conditions, are subject to change.  Therefore, if the agreement for reserving a Car Park Pass is not concluded because TOBILET.PL has failed to receive the payment – and therefore the full transaction amount has not been credited to the bank account of TOBILET.PL – within 3 hours of the User clicking the “Order with payment obligation” button, it may not be possible to reserve Car Park Passes at the price originally selected by the User.

§ 5. Intermediation in the Sale of the FAST TRACK Service

1. The agreement for the intermediation in the sale of the FAST TRACK Service is concluded when the User clicks on the “I order with obligation to pay” button, under the condition precedent that TOBILET.PL receives the payment made by the User, which shall be understood to mean crediting the bank account of TOBILET.PL with the full amount of the transaction, within 3 hours of the User clicking on the “I order with obligation to pay” button. At the same moment, a sales agreement for the FAST TRACK Service is concluded between the User and the Airport Operator.

2. In order to conclude an agreement for the intermediation in the sale of the FAST TRACK Service and for the purchase of the FAST TRACK Service, it is necessary to:

1) provide data regarding the number of accompanying persons, date and time of the planned departure,

2) provide the User's data: e-mail address, first name, surname and telephone number,

3) choose a payment method from among those indicated in item 6) below,

4) read and accept the Terms and Conditions, Privacy Policy, regulations applied by the Airport Operator and regulations applied by the external payment operator cooperating with TOBILET.PL – Website www.payu.pl,

5) submit a declaration that the User demands full performance of the Service within the time limit specified in the order, even if any part of the service is provided before the expiry of the time limit for withdrawal from the agreement (by the Consumer and the Sole Trader), as well as acknowledges that upon the provision of the service in the aforementioned part, they will lose the right to withdraw from the agreement in this part (if they are a Consumer or a Sole Trader),

6) make a payment via an external payment operator cooperating with TOBILET.PL - the website www.payu.pl, using one of the following payment methods:

a) VISA Mobile,

b) VISA or Master Card,

c) Google Pay,

d) BLIK, 

e) bank transfer,

in accordance with the terms and conditions applied by the website www.payu.pl.

3. When ordering FAST TRACK Service and paying for it, the User shall exercise due diligence. Entering incorrect data may result in the refusal to post the payment and cancellation of the transaction.

4. By clicking the “Order with payment obligation” button, the User expresses their willingness to conclude an agreement for the intermediation in the sale of the FAST TRACK Service and at the same time secures for themselves – for the period indicated in this section – the possibility of concluding this agreement. After clicking the “Order with payment obligation” button, TOBILET.PL sends the User an order confirmation to the email address provided by the User, and the User is redirected to the website of an external electronic payment operator cooperating with TOBILET.PL. The User will lose the opportunity to conclude an agreement for the intermediation in the sale of the FAST TRACK Service, and the agreement in question will not be concluded if TOBILET.PL fails to receive payment made by the User - which should be understood as crediting the bank account of TOBILET.PL with the full amount of the transaction - within 3 hours of the User clicking on the “Order with payment obligation” button. The user should verify that the bank account of TOBILET.PL has been credited with the full amount of the transaction and, in case of any problems, contact the external electronic payment operator cooperating with TOBILET.PL.

5. Upon receipt of the payment made by the User, understood as crediting the bank account of TOBILET.PL with the full transaction amount, TOBILET.PL sends the User a purchase confirmation (as an email attachment) and a payment confirmation to the email address provided by the User. TOBILET.PL also sends an invoice to the e-mail address provided by the User in the form of an attachment, provided that the User has agreed to receive it before clicking the “Order with payment obligation” button and has provided the details of the entity to be indicated on the invoice.

6. In case of any doubts as to the correctness of the purchase process of the FAST TRACK Service, please contact the Customer Service Department.

7. When intending to use the FAST TRACK Service, the User should have access to a confirmation of its purchase – printed or in electronic form.

8. The User is obliged to check that the data/information contained in the purchase confirmation corresponds to the order placed.

9. FAST TRACK Service prices are subject to change. Therefore, if the agreement for intermediation in the sale of the FAST TRACK Service is not concluded because TOBILET.PL has failed to receive the payment – and therefore the full transaction amount has not been credited to the bank account of TOBILET.PL – within 3 hours of the User clicking the “Order with payment obligation” button, it may not be possible to purchase the FAST TRACK Service at the price originally selected by the User.

§ 6. Intermediation in the Sale of the VIP Check-In Service

1. The agreement for the intermediation in the sale of the VIP Check-In Service is concluded when the User clicks on the “I order with obligation to pay” button, under the condition precedent that TOBILET.PL receives the payment made by the User, which shall be understood to mean crediting the bank account of TOBILET.PL with the full amount of the transaction, within 3 hours of the User clicking on the “I order with obligation to pay” button. At the same moment, a sales agreement for the VIP Check-In Service is concluded between the User and the Airport Operator.

2. In order to conclude an agreement for the intermediation in the sale of the VIP Check-In Service and for the purchase of the VIP Check-In Service, it is necessary to:

1) provide the traveller's name, contact telephone number, details of the number of accompanying persons, flight number, type of connection, destination, date and time of the planned departure,

2) provide the User's data: e-mail address, first name, surname and telephone number,

3) choose a payment method from among those indicated in item 6) below,

4) read and accept the Terms and Conditions, Privacy Policy, regulations applied by the Airport Operator and regulations applied by the external payment operator cooperating with TOBILET.PL – Website www.payu.pl, 

5) submit a declaration that the User demands full performance of the Service within the time limit specified in the order, even if any part of the service is provided before the expiry of the time limit for withdrawal from the agreement (by the Consumer and the Sole Trader), as well as acknowledges that upon the provision of the service in the aforementioned part, they will lose the right to withdraw from the agreement in this part (if they are a Consumer or a Sole Trader),

6) make a payment via an external payment operator cooperating with TOBILET.PL - the Website www.payu.pl, using one of the following payment methods:

a) VISA Mobile,

b) VISA or Master Card,

c) Google Pay,

d) BLIK,

e) bank transfer,

in accordance with the terms and conditions applied by the website www.payu.pl.

3. When ordering the VIP Check-In Service and paying for it, the User shall exercise due diligence. Entering incorrect data may result in the refusal to post the payment and cancellation of the transaction.

4. By clicking the “Order with payment obligation” button, the User expresses their willingness to conclude an agreement for the intermediation in the sale of the VIP Check-In Service and at the same time secures for themselves – for the period indicated in this section – the possibility of concluding this agreement. After clicking the “Order with payment obligation” button, TOBILET.PL sends the User an order confirmation to the email address provided by the User, and the User is redirected to the website of an external electronic payment operator cooperating with TOBILET.PL. The User will lose the opportunity to conclude an agreement for the intermediation in the sale of the VIP Check-In Service, and the agreement in question will not be concluded if TOBILET.PL fails to receive payment made by the User - which should be understood as crediting the bank account of TOBILET.PL with the full amount of the transaction - within 3 hours of the User clicking on the “Order with payment obligation” button. The user should verify that the bank account of TOBILET.PL has been credited with the full amount of the transaction and, in case of any problems, contact the external electronic payment operator cooperating with TOBILET.PL.

5. Upon receipt of the payment made by the User, understood as crediting the bank account of TOBILET.PL with the full transaction amount, TOBILET.PL sends the User a purchase confirmation (as an email attachment) and a payment confirmation to the email address provided by the User. TOBILET.PL also sends an invoice to the e-mail address provided by the User in the form of an attachment, provided that the User has agreed to receive it before clicking the “Order with payment obligation” button and has provided the details of the entity to be indicated on the invoice.

6. In case of any doubts as to the correctness of the purchase process of the VIP Check-In Service, please contact the Customer Service Department.

7. When intending to use the VIP Check-In Service, the User should have access to a confirmation of its purchase – printed or in electronic form.

8. The User is obliged to check that the data/information contained in the purchase confirmation corresponds to the order placed.

9. VIP Check-In Service prices are subject to change. Therefore, if the agreement for intermediation in the sale of the VIP Check-In Service is not concluded because TOBILET.PL has failed to receive the payment – and therefore the full transaction amount has not been credited to the bank account of TOBILET.PL – within 3 hours of the User clicking the “Order with payment obligation” button, it may not be possible to purchase the VIP Check-In Service at the price originally selected by the User.

§ 7. Intermediation in the Sale of the Drive Me Service

1. The agreement for the intermediation in the sale of the Drive Me Service is concluded when the User clicks on the “I order with obligation to pay” button, under the condition precedent that TOBILET.PL receives the payment made by the User, which shall be understood to mean crediting the bank account of TOBILET.PL with the full amount of the transaction, within 3 hours of the User clicking on the “I order with obligation to pay” button. At the same moment, a sales agreement for the Drive Me Service is concluded between the User and the Airport Operator.

2. In order to conclude an agreement for the intermediation in the sale of the Drive Me Service and for the purchase of the Drive Me Service, it is necessary to:

1) provide the traveller's name, contact telephone number, details of the number of accompanying persons, flight number, type of connection, destination, date and time of the planned departure,

2) provide the User's data: e-mail address, first name, surname and telephone number,

3) choose a payment method from among those indicated in item 6) below,

4) read and accept the Terms and Conditions, Privacy Policy, regulations applied by the Airport Operator and regulations applied by the external payment operator cooperating with TOBILET.PL – Website www.payu.pl, 

5) submit a declaration that the User demands full performance of the Service within the time limit specified in the order, even if any part of the service is provided before the expiry of the time limit for withdrawal from the agreement (by the Consumer and the Sole Trader), as well as acknowledges that upon the provision of the service in the aforementioned part, they will lose the right to withdraw from the agreement in this part (if they are a Consumer or a Sole Trader),

6) make a payment via an external payment operator cooperating with TOBILET.PL - the Website www.payu.pl, using one of the following payment methods:

a) VISA Mobile,

b) VISA or Master Card,

c) Google Pay,

d) BLIK,

e) bank transfer,

in accordance with the terms and conditions applied by the website www.payu.pl.

3. When ordering the Drive Me Service and paying for it, the User shall exercise due diligence. Entering incorrect data may result in the refusal to post the payment and cancellation of the transaction.

4. By clicking the “Order with payment obligation” button, the User expresses their willingness to conclude an agreement for the intermediation in the sale of the Drive Me Service and at the same time secures for themselves – for the period indicated in this section – the possibility of concluding this agreement. After clicking the “Order with payment obligation” button, TOBILET.PL sends the User an order confirmation to the email address provided by the User, and the User is redirected to the website of an external electronic payment operator cooperating with TOBILET.PL. The User will lose the opportunity to conclude an agreement for the intermediation in the sale of the Drive Me Service, and the agreement in question will not be concluded if TOBILET.PL fails to receive payment made by the User - which should be understood as crediting the bank account of TOBILET.PL with the full amount of the transaction - within 3 hours of the User clicking on the “Order with payment obligation” button. The user should verify that the bank account of TOBILET.PL has been credited with the full amount of the transaction and, in case of any problems, contact the external electronic payment operator cooperating with TOBILET.PL.

5. Upon receipt of the payment made by the User, understood as crediting the bank account of TOBILET.PL with the full transaction amount, TOBILET.PL sends the User a purchase confirmation (as an email attachment) and a payment confirmation to the email address provided by the User. TOBILET.PL also sends an invoice to the e-mail address provided by the User in the form of an attachment, provided that the User has agreed to receive it before clicking the “Order with payment obligation” button and has provided the details of the entity to be indicated on the invoice.

6. In case of any doubts as to the correctness of the purchase process of the Drive Me Service, please contact the Customer Service Department.

7. When intending to use the Drive Me Service, the User should have access to a confirmation of its purchase – printed or in electronic form.

8. The User is obliged to check that the data/information contained in the purchase confirmation corresponds to the order placed.

9. Drive Me Service prices are subject to change. Therefore, if the agreement for intermediation in the sale of the Drive Me Service is not concluded because TOBILET.PL has failed to receive the payment – and therefore the full transaction amount has not been credited to the bank account of TOBILET.PL – within 3 hours of the User clicking the “Order with payment obligation” button, it may not be possible to purchase the Drive Me Service at the price originally selected by the User.

§ 8. Intermediation in the Sale of the Business Executive Lounge Service

1. The agreement for the intermediation in the sale of the Business Executive Lounge Service is concluded when the User clicks on the “I order with obligation to pay” button, under the condition precedent that TOBILET.PL receives the payment made by the User, which shall be understood to mean crediting the bank account of TOBILET.PL with the full amount of the transaction, within 3 hours of the User clicking on the “I order with obligation to pay” button. At the same moment, a sales agreement for the Business Executive Lounge Service is concluded between the User and the Airport Operator.

2. In order to conclude an agreement for the intermediation in the sale of the Business Executive Lounge Service and for the purchase of the Business Executive Lounge Service, it is necessary to:

1) provide data regarding the number of accompanying persons, date and time of the planned departure,

2) provide the User's data: e-mail address, first name, surname and telephone number,

3) choose a payment method from among those indicated in item 6) below,

4) read and accept the Terms and Conditions, Privacy Policy, regulations applied by the Airport Operator and regulations applied by the external payment operator cooperating with TOBILET.PL – Website www.payu.pl, 

5) submit a declaration that the User demands full performance of the Service within the time limit specified in the order, even if any part of the service is provided before the expiry of the time limit for withdrawal from the agreement (by the Consumer and the Sole Trader), as well as acknowledges that upon the provision of the service in the aforementioned part, they will lose the right to withdraw from the agreement in this part (if they are a Consumer or a Sole Trader),

6) make a payment via an external payment operator cooperating with TOBILET.PL - the Website www.payu.pl, using one of the following payment methods:

a) VISA Mobile,

b) VISA or Master Card,

c) Google Pay,

d) BLIK,

e) bank transfer,

in accordance with the terms and conditions applied by the website www.payu.pl.

3. When ordering the Business Executive Lounge Service and paying for it, the User shall exercise due diligence. Entering incorrect data may result in the refusal to post the payment and cancellation of the transaction.

4. By clicking the “Order with payment obligation” button, the User expresses their willingness to conclude an agreement for the intermediation in the sale of the Business Executive Lounge Service and at the same time secures for themselves – for the period indicated in this section – the possibility of concluding this agreement. After clicking the “Order with payment obligation” button, TOBILET.PL sends the User an order confirmation to the email address provided by the User, and the User is redirected to the website of an external electronic payment operator cooperating with TOBILET.PL. The User will lose the opportunity to conclude an agreement for the intermediation in the sale of the Business Executive Lounge Service, and the agreement in question will not be concluded if TOBILET.PL fails to receive payment made by the User - which should be understood as crediting the bank account of TOBILET.PL with the full amount of the transaction - within 3 hours of the User clicking on the “Order with payment obligation” button. The user should verify that the bank account of TOBILET.PL has been credited with the full amount of the transaction and, in case of any problems, contact the external electronic payment operator cooperating with TOBILET.PL. 

5. Upon receipt of the payment made by the User, understood as crediting the bank account of TOBILET.PL with the full transaction amount, TOBILET.PL sends the User a purchase confirmation (as an email attachment) and a payment confirmation to the email address provided by the User. TOBILET.PL also sends an invoice to the e-mail address provided by the User in the form of an attachment, provided that the User has agreed to receive it before clicking the “Order with payment obligation” button and has provided the details of the entity to be indicated on the invoice.

6. In case of any doubts as to the correctness of the purchase process of the Business Executive Lounge Service, please contact the Customer Service Department.

7. When intending to use the Business Executive Lounge Service, the User should have access to a confirmation of its purchase – printed or in electronic form.

8. The User is obliged to check that the data/information contained in the purchase confirmation corresponds to the order placed.

9. Business Executive Lounge Service prices are subject to change. Therefore, if the agreement for intermediation in the sale of the Business Executive Lounge Service is not concluded because TOBILET.PL has failed to receive the payment – and therefore the full transaction amount has not been credited to the bank account of TOBILET.PL – within 3 hours of the User clicking the “Order with payment obligation” button, it may not be possible to purchase the Business Executive Lounge Service at the price originally selected by the User.

§ 9. Intermediation in the Sale of the Meet&Assist Service

1. The agreement for the intermediation in the sale of the Meet&Assist Service is concluded when the User clicks on the “I order with obligation to pay” button, under the condition precedent that TOBILET.PL receives the payment made by the User, which shall be understood to mean crediting the bank account of TOBILET.PL with the full amount of the transaction, within 3 hours of the User clicking on the “I order with obligation to pay” button. At the same moment, a sales agreement for the Meet&Assist Service is concluded between the User and the Airport Operator.

2. In order to conclude an agreement for the intermediation in the sale of the Meet&Assist Service and for the purchase of the Meet&Assist Service, it is necessary to:

1) provide the traveller's name, contact telephone number, details of the number of accompanying persons, flight number, type of connection, destination, date and time of the planned departure,

2) provide the delivery data: e-mail address, first name, surname and telephone number,

3) choose a payment method from among those indicated in item 6) below,

4) read and accept the Terms and Conditions, Privacy Policy, regulations applied by the Airport Operator and regulations applied by the external payment operator cooperating with TOBILET.PL – Website www.payu.pl, 

5) submit a declaration that the User demands full performance of the Service within the time limit specified in the order, even if any part of the service is provided before the expiry of the time limit for withdrawal from the agreement (by the Consumer and the Sole Trader), as well as acknowledges that upon the provision of the service in the aforementioned part, they will lose the right to withdraw from the agreement in this part (if they are a Consumer or a Sole Trader),

6) make a payment via an external payment operator cooperating with TOBILET.PL - the Website www.payu.pl, using one of the following payment methods:

a) VISA Mobile,

b) VISA or Master Card,

c) Google Pay,

d) BLIK, 

e) bank transfer,

in accordance with the terms and conditions applied by the website www.payu.pl.

3. When ordering the Meet&Assist Service and paying for it, the User shall exercise due diligence. Entering incorrect data may result in the refusal to post the payment and cancellation of the transaction. 

4. By clicking the “Order with payment obligation” button, the User expresses their willingness to conclude an agreement for the intermediation in the sale of the Meet&Assist Service and at the same time secures for themselves – for the period indicated in this section – the possibility of concluding this agreement. After clicking the “Order with payment obligation” button, TOBILET.PL sends the User an order confirmation to the email address provided by the User, and the User is redirected to the website of an external electronic payment operator cooperating with TOBILET.PL. The User will lose the opportunity to conclude an agreement for the intermediation in the sale of the Meet&Assist Service, and the agreement in question will not be concluded if TOBILET.PL fails to receive payment made by the User - which should be understood as crediting the bank account of TOBILET.PL with the full amount of the transaction - within 3 hours of the User clicking on the “Order with payment obligation” button. The user should verify that the bank account of TOBILET.PL has been credited with the full amount of the transaction and, in case of any problems, contact the external electronic payment operator cooperating with TOBILET.PL.

5. Upon receipt of the payment made by the User, understood as crediting the bank account of TOBILET.PL with the full transaction amount, TOBILET.PL sends the User a purchase confirmation (as an email attachment) and a payment confirmation to the email address provided by the User. TOBILET.PL also sends an invoice to the e-mail address provided by the User in the form of an attachment, provided that the User has agreed to receive it before clicking the “Order with payment obligation” button and has provided the details of the entity to be indicated on the invoice. 

6. In case of any doubts as to the correctness of the purchase process of the Meet&Assist Service, please contact the Customer Service Department. 

7. When intending to use the Meet&Assist Service, the User should have access to a confirmation of its purchase – printed or in electronic form.

8. The User is obliged to check that the data/information contained in the purchase confirmation corresponds to the order placed.

10. Meet&Assist Service prices are subject to change. Therefore, if the agreement for intermediation in the sale of the Meet&Assist Service is not concluded because TOBILET.PL has failed to receive the payment – and therefore the full transaction amount has not been credited to the bank account of TOBILET.PL – within 3 hours of the User clicking the “Order with payment obligation” button, it may not be possible to purchase the Meet&Assist Service at the price originally selected by the User.

§ 10. Browsing of Content Available on the Website

1. TOBILET.PL enables the User to browse information about the Services available on the Website. 

2. Using the functionality described above requires reviewing the Terms and Conditions and Privacy Policy and accepting the Terms and Conditions and Privacy Policy – it is not possible to use the Website without accepting the Terms and Conditions and Privacy Policy. 

3. Upon meeting the requirements set out in sec. 2 above, an agreement for the provision of the Service described in sec. 1 is concluded with TOBILET.PL. 

4. The Service described in sec. 1 is provided for an indefinite period. The related agreement is concluded for an indefinite term and may be terminated by the User at any time by submitting a termination notice to TOBILET.PL. The User may also terminate the agreement without submitting a termination notice by simply closing the webpage where the Website is available.

§ 11. Chat

1. As part of the Website, TOBILET.PL enables Users to chat with a TOBILET.PL consultant. 

2. To send a message to TOBILET.PL via chat, the User should enter the message content into the designated button and click the “START CHAT” button. 

3. Upon clicking the “START CHAT” button, an Agreement for the provision of the chat Service is concluded.

4. The service described in sec. 1 is provided for an indefinite period. The related agreement is concluded for an indefinite term and may be terminated by the User at any time by submitting a termination notice to TOBILET.PL. The User may also terminate the agreement without submitting a termination notice by closing the webpage where the Website is available.

5. Upon receiving a message from the User via chat, TOBILET.PL will also respond to the User via chat.

6. The use of bots or other automated ICT tools that enable communication with TOBILET.PL via chat without human intervention is prohibited.

7. The User may discontinue correspondence with TOBILET.PL via chat at any time.

§ 12. Invoices

1. Invoices are sent to the email address provided by the User if, before clicking the “Order with payment obligation” button, the User selected the option to request an invoice and provided the necessary details for its issuance.

2. If the User wishes to request an invoice after purchasing the Service or to correct an invoice, they should send the necessary details for invoice issuance or correction (i.e. entity details, transaction number, and gross price) along with their request to the email address: info@tobilet.pl.

§ 13. Liability

1. TOBILET.PL is obliged to properly perform the Services, including executing them in accordance with the concluded agreement and the Terms and Conditions. 

2. TOBILET.PL is liable to the User under the general principles set out in the Civil Code of 23 April 1964 (consolidated text Journal of Laws of 2024, item 1061, as amended).  In particular, TOBILET.PL is obliged to compensate for any damage resulting from non-performance or improper performance of the Services and other obligations specified in the Terms and Conditions, unless such non-performance or improper performance is due to circumstances for which TOBILET.PL is not liable. 

3. TOBILET.PL shall not be liable for the consequences of incomplete or incorrect data provided by the User. 

4. TOBILET.PL reserves the right to temporarily suspend the operation of the Website due to technical reasons caused by a failure or the necessity to carry out Website maintenance. 

§ 14. Withdrawal from the Agreement

1. The following provisions apply to the right of withdrawal from the agreement by a User who has the status of a Consumer or a Sole Trader as defined in Art. 27 sec. 1 of the PCRA. 

2. If the agreement concerning the Services specified in § 2 sec. 4 items a-f was concluded later than the fifteenth day before the commencement of such Service, the User shall not have the right to withdraw from the agreement without stating a reason and incurring costs, as referred to in Article 27 sec. 1 of the PCRA, to the extent that the Service has already been performed. This applies in light of the declaration specified in § 4 sec. 2 item 6, § 5 sec. 2 item 5, § 6 sec. 2 item 5, § 7 sec. 2 item 5, § 8 sec. 2 item 5, and § 9 sec. 2 item 5 of the Terms and Conditions (depending on the Service to which the agreement pertains).

3. Except for the case described in sec. 2 above, the User has the right to withdraw from the agreement without stating a reason and without incurring costs.

4. The User may withdraw from the agreement within 14 days from the date of its conclusion. To meet this deadline, it is sufficient to send a withdrawal statement to TOBILET.PL before the deadline expires.

5. The withdrawal statement may be submitted electronically to reklamacje@tobilet.pl, by post to Międzynarodowe Targi Poznańskie sp. z o.o., ul. Głogowska 14, 60-734 Poznań, or in any other manner convenient for the User.  The User may use the model withdrawal form included in Appendix No. 2 to the PCRA; however, this is not mandatory.

6. In the event of withdrawal from the agreement by the User, TOBILET.PL shall refund all payments made by the User, except for the fee charged by the external payment operator cooperating with TOBILET.PL – website www.payu.pl. The refund shall be made using the same payment method used by the User, without undue delay and no later than 14 days from the date TOBILET.PL receives the withdrawal statement.

§ 15. Processing of Users' Personal Data

1. The data controller, as defined in Art. 4 sec. 7 of the GDPR, is TOBILET.PL.  TOBILET.PL processes Users' personal data for the purpose of providing Services, in particular to enable Users to use the Website, ensure its functionality, and conclude and perform agreements with Users as data subjects, based on Art. 6 sec. 1 item b of the GDPR. 

2. Providing personal data is voluntary, but failure to do so will prevent the use of the Services, particularly the conclusion and execution of an agreement for the provision of Services, if providing the data is necessary for this purpose. TOBILET.PL processes the personal data provided by the User during the reservation of a given Service.

3. TOBILET.PL has appointed a Data Protection Officer (DPO), who can be contacted using TOBILET.PL’s contact details with the note “GDPR”, as well as via the dedicated email address: iod@grupamtp.pl.

4. TOBILET.PL may transfer Users' personal data to the Airport Operator, Car Park Operator, payment operators cooperating with TOBILET.PL, as well as entities providing IT, analytical, legal, accounting, consulting, and cybersecurity services to TOBILET.PL.

5. TOBILET.PL may also process Users' personal data based on:

1) Art. 6 sec. 1 item a) of the GDPR, i.e. Users' voluntary consent for purposes specified each time in the respective consent clause; 

2) Art. 6 sec. 1 item c) of the GDPR, i.e. compliance with legal obligations imposed on TOBILET.PL in connection with the provision of Services, such as accounting and User service; 

3) Art. 6 sec. 1 item f) of the GDPR, i.e. TOBILET.PL’s legitimate interest, which includes analysis, improvement, and enhancement of the functionality of the Website, as well as the establishment, exercise, or defence of legal claims.

6. TOBILET.PL processes Users' personal data for the duration necessary to achieve the processing purposes, particularly throughout the provision of Services, and subsequently for the period required to establish, defend, or pursue claims related to the provision of Services, but no longer than 10 years after the completion of the Services.  In the case of personal data processed based on voluntary consent, TOBILET.PL processes such data until the consent is withdrawn by the User. 

7. TOBILET.PL collects certain information automatically using cookies and similar technologies when Users access the Website.  Such collected information may include: browser type, operating system, visited URLs, language, country, and actions performed by Users while using the Website.  This information may allow for User identification, thereby constituting personal data within the meaning of Art. 4 sec. 1 of the GDPR.

8. Users have the right to request from TOBILET.PL access to their personal data, rectification or erasure of the data, or restriction of their processing. Additionally, they have the right to object to the data processing and to data portability.  If personal data is processed based on Users' voluntary consent, Users have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.  Moreover, Users have the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that their data is processed in violation of the GDPR. 

9. Further details regarding the processing of Users' personal data, including the use of cookies, are available in the Privacy Policy.

§ 16. Complaint-Handling Procedure

1. TOBILET.PL informs that complaints regarding the Airport Operator's Services should be submitted in accordance with the regulations for those services, by email: info@airport-poznan.com.pl, by phone: +48 61 849 22 99, by post: PORT LOTNICZY POZNAŃ-ŁAWICA sp. z o.o., with its registered office in Poznań, ul. Bukowska 285, 60-189 Poznań, as well as in any other manner convenient for the User

2. Each User has the right to lodge a complaint regarding matters related to the functioning of the Website and the provision of Services by TOBILET.PL. The following provision applies exclusively to these complaints.

3. The complaints may be submitted electronically to reklamacje@tobilet.pl, by post to Międzynarodowe Targi Poznańskie sp. z o.o., ul. Głogowska 14, 60-734 Poznań, or in any other manner convenient for the User.

4. The complaint shall be investigated within 14 days from the date its receipt by TOBILET.PL.

5. The response to the complaint shall be sent by e-mail or by regular mail to the appropriate address provided by the User during complaint procedure.

6. If TOBILET.PL considers the complaint as unjustified, the User who is a Consumer may use extrajudicial means of handling complaints and pursuing claims. The User who is a Consumer may ask for help from consumer organizations and municipal or district consumer ombudsmen. Detailed information on the use of extrajudicial means of handling complaints and pursuing claims by the User, who is a Consumer, as well as the rules of access to these procedures are available at the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl.

§ 17. Amendment to the Terms and Conditions and Termination of the Agreement by TOBILET.PL

1. The Terms and Conditions may be amended by TOBILET.PL in the event of an editorial change or in the event of at least one of the important reasons indicated below (closed catalogue): 

1) a change in the scope of Services, including the introduction of new Services, 

2) the need to update the data of TOBILET.PL, the Airport Operator or the Car Park Operator indicated in the Terms and Conditions, 

3) a change in the way the Website functions or the Services are provided, related to the appearance of new functionalities or the removal of existing functionalities or aimed at improving the functioning of the Website or Services provided, 

4) a change in the law having a direct impact on the content hereof, 

5) a change in the Privacy Policy having a direct impact on the content hereof, 

6) safety considerations,

7) the issuance of a judgement, order or decision that has a direct impact on the content hereof,

8) a change in the way the Website operates or services are provided by TOBILET.PL, resulting from technical or technological reasons.

2. TOBILET.PL shall notify of any changes to the Terms and Conditions by publishing a new version hereof on the Website, unless otherwise stipulated by applicable law or a judgement, order or decision. 

3. The change to the Terms and Conditions shall become effective 14 days after the User has been notified of the change and the amended Terms and Conditions have been made available to the User on the Website.  TOBILET.PL may introduce a change to the Terms and Conditions without observing the aforementioned deadline, including with immediate effect, if the need to change the Terms and Conditions results from a change in the law having a direct impact on the content of the Terms and Conditions or the issuance of a judgement, order or decision that has a direct impact on the content of the Terms and Conditions, and as a result of any of the aforementioned circumstances, the change to the Terms and Conditions must be introduced within a shorter period of time, including with immediate effect. 

4. If the User does not accept the planned changes to the Terms and Conditions, they may terminate the agreement for the provision of the Service enabling the browsing of content available on the Website or the agreement for the provision of the chat Service, or close the webpage under which the Website is available.

5. With regard to other Services (Car Park Pass Booking Service, Intermediation in the Sale of the FAST TRACK Service, Intermediation in the Sale of the VIP Check-in Service, Intermediation in the Sale of the Drive Me Service, Intermediation in the Sale of the Business Executive Lounge Service, Intermediation in the Sale of the Meet&Assist Service) - as they are not of a continuous nature - the version of the Terms and Conditions accepted at the conclusion of the agreement concerning them remains binding, unless otherwise results from amended legal provisions having a direct impact on the content of the Terms and Conditions or a judgement, order or decision that has a direct impact on the content of the Terms and Conditions.

6. The Agreement for the provision of the Service of browsing of the content available on the Website and the Agreement for the provision of the chat Service may be terminated by TOBILET.PL with a 3-month notice period in the event of:

1) planned termination of the provision of the aforementioned Services, 

2) planned change to the terms of provision of the aforementioned Services,

3) the necessity to terminate the aforementioned agreement resulting from a change in legal regulations having a direct impact on this agreement or the issuance of a judgement, order or decision having a direct impact on this agreement - in such a case, the notice period may differ from that indicated above if it results from legal regulations, a judgement, order or decision.

§ 18. Final Provisions

1. The Terms and Conditions shall be binding from 31 March 2025.

2. In accordance with the provisions of the Whistleblower Protection Act of 14 June 2024, TOBILET.PL has introduced the “Procedure for Reporting Internal Breaches of Law in force at Międzynarodowe Targi Poznańskie sp. z o.o.” and enables the reporting of irregularities and violations of the law identified in cooperation with TOBILET.PL, both openly and anonymously, via the email address naruszeniaprawa@grupamtp.pl.  In the “legal violations” tab available on the website www.grupamtp.pl, you can read about the rules used by TOBILET.PL to process reports.

3. None of the provisions of the Terms and Conditions limit the Consumer's or Sole Trader's rights under the law, including the right to terminate the agreement.  If a provision is found to exist that limits the aforementioned rights, the provisions of generally applicable law shall apply, in particular the Polish Civil Code and the Polish Consumer Rights Act of 30 May 2014 (consolidated text Journal of Laws of 2024, item 1796).

4. TOBILET.PL shall not apply the code of good practices referred to in the Act of 23 August 2007 on counteracting unfair market practices.

5. Any disputes arising from or related to the functioning of the Website or the provision of Services via the Website shall be settled by a common court competent for the registered office of TOBILET.PL.  This provision shall not apply to Consumers and Sole Traders.

6. These Regulations shall be governed by Polish law. This provision shall not apply to Consumers and Sole Traders.
